Call for immediate legal reforms
Parental Alienation Syndrome (PAS) is a distressing phenomenon where a child is deliberately estranged from one parent through psychological, physical, mental, sexual, coercion, intimidation, blackmail, manipulation, and abuse by the abusive child-abusing parent. This condition not only fractures the child’s relationship with the targeted and alienated parent but also causes long-lasting emotional and psychological trauma.
The Destruction of Support Networks
Parental Alienation Syndrome systematically destroys a child’s entire support network. Friends, extended family members, and even teachers who were once sources of stability and support are often cut off. The alienating parent or child abuser isolates the child, creating a dependency that only deepens the trauma. This isolation not only impacts the child’s current well-being but also affects their ability to form healthy relationships in the future.
Trauma Bonded Children
Children subjected to parental alienation often develop trauma bonds with the child-abusing alienating parent. These bonds are formed out of fear, dependency, and manipulation, making it incredibly difficult for the child to break free from the toxic relationship. The child may internalize the alienating parent’s highly negative views of the other parent, which will ultimately lead to long-term psychological issues such as anxiety, depression, and difficulties in trust and relationship-building.
What is a trauma-bonded relationship?
A trauma bond is when a person forms a deep emotional attachment with someone that causes them harm. It often develops from a repeated cycle of abuse and positive reinforcement. When this occurs between a child-abusing parent and child, this is when a trauma-bonded relationship is formend.
Legal Reforms: Criminalizing Parental Alienation Syndrome
The Official Fathers 4 Justice South Africa (F4J SA) strongly advocates for the immediate criminalization of Parental Alienation Syndrome and its integration into the Domestic Violence Act. F4J SA insists that the presiding officers (judges or magistrates) must have zero discretion in applying sentences for these offenses to ensure direct, automatic, strict enforcement and justice for abused children and targeted parents.
F4J SA calls for urgent and stringent measures against parents and their legal and psychological representatives or more specifically their enablers who make false allegations to deny contact or alienate the child from the other parent. These actions should be tied to the criminal act of perjury, for both the child-abusing parent and his or her legal and psychological team with presiding officers having no discretion in applying the sentence.
Legal Accountability for Professionals
Lawyers, advocates, psychologists, and social workers must automatically adhere and be bound by default to a draconian set of laws regarding their conduct when handling family law-related matters, specifically around Parental Alienation Syndrome. These laws should have automatic, dire immediate consequences for failure to abide by this legal code of conduct. Ensuring direct personal, as well as personal accountability among these professionals, is crucial to preventing the perpetuation of parental alienation and safeguarding children’s well-being.
