I’m a biological father and primary care-giver of a 16 year old boy (meeting all the provisions of sections 7, 9, 18 and 21 of Act 38 of 2005), who has since been living with the biological mother from August 2022. During the 2023 New Year’s holidays, my boy could not return to his habitual or normal residence at eMalahleni. This was due to his mother’s request that Kgotsofalo takes care of his younger sibling [abandoning and neglecting both her children, and using my son as a caregiver to the younger child (a form of child labour)] whilst the mother was away at work (orange farming).
    Furthermore, she used my son’s way of belief to advantage her in her unlawful (forum shopping, perjury) maintenance order pursuit during 2022/2023.
    I need help (Notice of Motion) with an application (Founding Affidavit) for sole custody of my son.
    How do I go about acquiring your benevolent assistance in this regard?
