Rights of first born to Child support |
|
Hi,
I am a father of 3 children, all have different mothers. I am currently paying child support to all 3 timeously and as agreed in court.
The mother of my first born however wants to summon me for more support now. She says that the court will not take into account that I pay support to the other 2 children because her child is the first born.
Is this true?

Leon, I would say she's talking nonsense.
I do not believe that the law is concerned with the order in which children were born - only with their parentage and therefore with the responsibility of said parents to provide for them.
It seems she is confusing the 'ethnic' cultural predisposition to afford some sort of social status to the firstborn child over the subsequent children, and therefore elecvate the social standing of said child, with the way in which the law views individuals. And the constitution is quite clear on that - all citizens of the RofSA have equal standing in the eyes of the law.
Simply, no, she is NOT correct, and ALL children have equal rights in the eyes of the law with regard to maintenance and support.
Where the law MAY be different is when disposing of your assets after your demise - in that case there MAY be certain advantages to being the eldest child. But we're not talking about that here... hopefully...
